When I served as Seneschal this question was poised to me & was explained to me as such by a MARYLAND lawyer ... state laws "probably" vary

 

If I take a picture of anything in public domain It is Mine ... If I can see over your fence ... thru your window ... or paid a fee to access private property< i.e. an event> then this also is public domain & I may snap at will. Basically unless you are trespassing you are good. 

 

If you are in a public park or attending an event than any Image you take is your property. No release is required to put said Image on the web. If you wanted to charge someone to send them a Quality framed & matted Print that is also your option & still no release would be required as the fee could be just for shipping & handling ... BUT ... she defiantly said that Newspapers/Magazines/Publishers have other regulations that would rarely apply to a guy with a camera & a PC. Unless you could prove a financial loss or actual Physical damages you have allmost no recourse other than asking for the photo not to be used
