Any law that is defined as "I can't define it but know it when I see"
need to be gotten rid of, after all if you know it when you see it,
what is to stop you from defining it, is merely (in this case) doing
what you can to side step the First Amendment (or other legal
protections).

but on the topic at point I think if you can identify it you can
define it.  It is just, I would say laziness, but I think
unwillingness to do so that is all that stops one from doing so in
this case.

I can't identify it when I see it, so I can't define it (at least in a
period/SCA sense), modernly you don't want to know.
