Sadly though the swordman will most likely wish the intruder had killed him once the family sues him in civil court for wrongful death. Even if he doesn't get prosecuted for the crime by the state, he will undoubtedly be paying the relatives of the intruder for the rest of his life when he's sued by the relatives (assuming the thief has family).
