The clothing maker is Wal-Mart's house clothing line, so they have
some responsibility.
Copyright Law is a weird beast, but the scribe may have a claim for
damages, he or she needs to talk to a lawyer, and I am informed that
he or she is in that process.
Many scrolls are posted online. My money is on some designer at
Wal-Mart's clothing line doing a google images search for something
like "Middle Ages Calligraphy" or "Middle Ages Scroll" or something of
the like then finding an image of the scroll and assuming it was some
sort of total fantasy thing and freely useable.
